Please read these Terms of Use ("Terms") carefully before enrolling in or accessing The Delusion Killer™ Masterclass ("the Course"). By enrolling, purchasing, or accessing any portion of the Course, you agree to be legally bound by these Terms. If you do not agree, do not enroll or access the Course.
These Terms govern your use of the Course as delivered through the Thinkific platform and any supplemental content, community access, or communications provided by Vinton Poker in connection with the Course.
1. Definitions
- "Course" means The Delusion Killer™ Masterclass, including all video lessons, written materials, worksheets, frameworks, quizzes, assessments, supplemental downloads, and any live or recorded bonus content.
- "Content" means all written, audio, visual, and interactive materials contained within the Course, including but not limited to the PIPO methodology, strategic frameworks, lesson scripts, and any AI-assisted tools or diagnostics provided alongside the Course.
- "Vinton Poker," "we," "us," or "our" refers to the owner and operator of the Course and the vintonpoker.com website.
- "You" or "Student" means any individual who enrolls in, purchases, or accesses the Course.
- "Platform" means the Thinkific learning management system through which the Course is hosted and delivered.
2. Eligibility
You must be at least 18 years of age to enroll in or access the Course. By enrolling, you represent and warrant that you meet this age requirement. We reserve the right to terminate access for any account found to belong to a minor.
3. Enrollment and Course Access
3.1 Granting of Access
Upon successful payment, you will be granted a limited, non-exclusive, non-transferable license to access the Course for personal, non-commercial educational use only. Access is granted through the Thinkific platform and is tied to your individual account.
3.2 Account Security
You are responsible for maintaining the confidentiality of your Thinkific login credentials. You may not share your account, login link, or access with any other person. Any use of the Course through your account is your responsibility. Suspected account sharing may result in immediate termination of access without refund.
3.3 Platform Availability
The Course is delivered via Thinkific, a third-party platform. We do not guarantee uninterrupted access and are not liable for any downtime, technical failures, or access issues arising from Thinkific’s systems. We will make reasonable efforts to notify you of planned outages or significant disruptions.
3.4 Course Updates
We reserve the right to modify, update, add to, or remove Course content at any time without prior notice. We may improve, restructure, or replace materials to reflect our evolving curriculum. Access to updated materials is included within your original enrollment.
4. Intellectual Property
4.1 Ownership
All Content within the Course is the exclusive intellectual property of Vinton Poker and is protected by copyright, trademark, and other applicable laws. This includes, without limitation:
- All video lessons, audio recordings, and transcripts
- The PIPO methodology and all associated strategic frameworks
- Worksheets, templates, quizzes, and assessment tools
- All written guides, PDFs, and downloadable resources
- Any AI-assisted tools, prompts, or diagnostic outputs included with the Course
- The name and mark “Delusion Killer™” and all associated branding
4.2 License Restrictions
Your enrollment grants you a personal, non-transferable license to access and use the Course for your own educational purposes only. You may not:
- Copy, reproduce, duplicate, screenshot, or download Course Content in any form not expressly permitted
- Share, resell, sublicense, or distribute any Course Content to any third party
- Upload, post, or publicly display any Course Content on any platform, including social media, YouTube, or file-sharing services
- Use Course Content to create derivative works, competing courses, or educational materials
- Reverse engineer, extract, or replicate any methodology, framework, quiz logic, or AI tool included in the Course
- Misrepresent yourself as the creator or owner of any Course Content
4.3 Feedback and Submissions
Any feedback, testimonials, suggestions, or ideas you submit to us about the Course may be used by Vinton Poker without restriction, compensation, or attribution. Such submissions become the property of Vinton Poker upon submission.
5. Payment and Billing
All Course fees are listed in USD and are processed securely through Stripe. By completing your purchase, you authorize us to charge the stated amount to your selected payment method. Prices are subject to change without notice; changes will not affect completed purchases.
We do not store your payment card details. All payment data is handled directly by Stripe in accordance with their security standards. You agree to Stripe’s terms of service as a condition of payment.
6. Refund Policy
The Delusion Killer™ Masterclass carries a 30-day refund guarantee, subject to the following conditions:
- You must request your refund within 30 days of your original purchase date
- You must have completed at least 30% of the Course content as recorded by Thinkific
- You must demonstrate honest effort and genuine engagement with the Course materials
- Refund requests must be submitted to [email protected] with your order details
We reserve the right to deny refund requests in cases of:
- Bulk or rapid consumption of the Course followed by an immediate refund request
- Evidence of content downloading, screenshotting, or intellectual property extraction prior to refund
- Initiating a chargeback or payment dispute without first contacting us
- Abuse of the refund process or repeated purchases and refunds
Initiating a chargeback constitutes a material breach of these Terms. We reserve the right to terminate your account, report fraudulent chargebacks to payment partners, and pursue recovery of fees and associated costs.
No refunds are available after an arbitration proceeding relating to your purchase has been initiated.
7. Acceptable Use
By accessing the Course, you agree to the following conduct standards:
- Use the Course solely for your own personal, non-commercial educational development
- Treat all community spaces (including any associated Discord or Thinkific community) with professionalism and respect
- Refrain from harassment, abuse, trolling, spamming, or posting content that is discriminatory, offensive, or harmful
- Not promote or advertise external coaching services, courses, or competing products within any Course community without our prior written consent
- Not attempt to circumvent access controls, payment systems, or platform security
- Comply with Thinkific’s platform terms of service and community guidelines
We reserve the right to suspend or permanently revoke Course access for any violation of these conduct standards at our sole discretion, without refund.
8. Disclaimers
8.1 Educational Purpose Only
The Course is provided for educational and informational purposes only. All content, strategies, frameworks, and coaching insights are general in nature and are not tailored to your individual financial situation, bankroll, skill level, or personal circumstances.
8.2 No Earnings or Results Guarantee
Poker involves inherent risk, variance, and skill. Nothing in the Course constitutes a guarantee of winnings, profitability, improved results, or any specific outcome at the poker table. Individual results will vary based on factors including but not limited to: experience, game selection, discipline, stakes played, and variance. No income or earnings claims are made or implied.
8.3 Not Professional Advice
Nothing in the Course constitutes financial, legal, psychological, or professional advice. You are solely responsible for your own decisions, bankroll management, and any outcomes resulting from your application of Course content.
8.4 Third-Party Platform
The Course is hosted on Thinkific, a third-party platform. We make no warranties regarding Thinkific’s performance, availability, or data practices. Thinkific’s own terms of service and privacy policy govern your use of their platform.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Vinton Poker, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your enrollment in or use of the Course, including but not limited to:
- Loss of profits or expected winnings
- Loss of data or course progress
- Decisions made based on Course content
- Financial losses at the poker table
- Platform outages or technical failures
Aggregate Liability Cap: Our total liability to you for any claim arising from these Terms or the Course shall not exceed the total amount you paid to Vinton Poker for the Course in the twelve (12) months preceding the event giving rise to the claim.
You agree to hold Vinton Poker harmless from any outcomes, losses, or damages arising from your use of or reliance on the Course.
10. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Course, or your enrollment shall be resolved exclusively through binding arbitration in the State of North Carolina, under the rules of the American Arbitration Association (AAA). By agreeing to these Terms, you waive your right to a jury trial and to participate in any class, collective, or representative action.
- Each party shall bear its own legal fees and costs unless the arbitrator awards otherwise
- Arbitration is the exclusive remedy; you may not bring claims in any court except to enforce an arbitration award
- No refunds or chargebacks may be initiated after arbitration has commenced
If any portion of this arbitration clause is found unenforceable, the remaining provisions shall continue in full force and effect.
11. Class Action Waiver
You agree that any claims against Vinton Poker must be brought in your individual capacity only. You waive any right to bring or participate in any class action, collective action, or representative proceeding related to the Course or these Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to its conflict-of-law provisions.
13. Modifications to These Terms
We reserve the right to update or modify these Terms at any time. Material changes will be communicated by email to your enrolled address or posted within the Course platform. Your continued access to the Course following any modification constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
14. Force Majeure
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, cyberattacks, or failures of third-party platforms including Thinkific, Stripe, or Netlify.
15. Severability and Entire Agreement
If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Vinton Poker regarding your use of the Course and supersede any prior agreements or representations.
16. Survival
Sections 4, 6, 7, 8, 9, 10, 11, 12, and 15 shall survive the termination or expiration of these Terms or your Course access.
